This is a 3-credit course, offered in accelerated format. This means that 16 weeks of material is covered in 8 weeks. The exact number of hours per week that you can expect to spend on each course will vary based upon the weekly coursework, as well as your study style and preferences. You should plan to spend 14-20 hours per week in each course reading material, interacting on the discussion boards, writing papers, completing projects, and doing research.
Course Description and Outcomes
Course Description:
This course will provide an overview of the criminal procedure under the U.S. Constitution, specifically as related to due process and crime control. Topics include the Fourth Amendment, self-incrimination, constitutional violations, court proceedings, and criminal procedures during national emergencies.
Course Overview:
This course is principally oriented toward a discussion of criminal procedure under the United States Constitution. The Constitution provides for criminal procedure to serve as a balance between due process and crime control. This course examines and analyzes the balance between maintaining the order of government and protecting the rights of the citizens and residents of the U.S.
Course Learning Outcomes:
1. Discuss the history and purpose of the United States Constitution as it relates to criminal defendants.
2. Identify the functions of the United States Supreme Court and how the Constitution relates to criminal justice, including limitations imposed on the criminal justice system.
3. Demonstrate a specific knowledge of the Fourth, Fifth, and Sixth Amendments and the U.S. Constitutional safeguards in the areas of arrest, search, and seizure; communications, eavesdropping; requirements for communications monitoring, the protections against self-incrimination and the “free and voluntary” rules governing interrogations.
4. Identify, define, and explain the protections of the Fourth, Fifth, and Sixth Amendments in the trial process.
5. Summarize recent constitutional issues, based on the right to privacy and the Exclusionary Rule, including electronic surveillance.

Assignment Choice #1: Constitutional Criminal Procedure and Due Process
Describe the concept and purpose of due process in constitutional criminal procedure. Explain from where in the Constitution due process protections arise and how due process is protected. What ethical issues arise in the area of due process? Give an example of due process being violated and an example of due process being upheld.

Assignment Choice #2: Case Analysis: Constitutional Criminal Procedure and Due Process
The Fourth, Fifth, Sixth, and Eighth Amendments protect the rights of suspected or accused persons, criminal defendants, and convicted criminals. The Supreme Court has held that these protections apply to state governments through the Fourteenth Amendment via the Incorporation Doctrine.
Choose one of the following cases:
Rochin v. California, 342 U.S. 165, 72 S. Ct. 205, 96 L. Ed. 183 (1952)
Duncan v. Louisiana, 391 U.S. 145, 88 S. Ct. 1444, 20 L. Ed. 2d 491 (1968)

Read the case and submit a case brief, analyzing the results of the case and explaining the applicable law. In your case brief, describe:
1) the procedural history of the case;
2) the relevant facts of the case;
3) the holding of the case;
4) the Court’s reasoning for the case.

This assignment introduces a fact pattern that will be continued through the course and end in the final Portfolio Project assignment in Week 8. Read the first part of the fact pattern here.
In a well-written paper, answer the following questions:
 What constitutional issues arise with respect to Amy’s case? Have her constitutional rights been violated and, if so, how? Have her constitutional rights been protected and, if so, how?
 What constitutional issues arise with respect to Bill’s case? Have his constitutional rights been violated and, if so, how? Have his constitutional rights been protected and, if so, how?
In your paper, address both clear constitutional violations as well as facts that may not be a constitutional violation but fall under the domain of constitutional criminal procedure. Assignment Choice #2: Critical Thinking and Case Analysis – Wrongly Convicted (150 points)
Visit The Innocence Project site at: http://www.innocenceproject.org/. The site has a fascinating discussion about mistaken eyewitness identification and offers links to other sites about the topic. It also discusses problems with scientific evidence, including DNA evidence and problems associated with forensic science crime labs.
Research a case of an exonerated defendant. Discuss the facts of the case and the constitutional violations that occurred during his or her case. Do not cut and paste a profile of an individual into your paper. Rather, summarize the facts and add your own reflections to the injustice(s) that occurred and as well as reflections regarding the eventual exoneration. Be sure your paper demonstrates an understanding the applicable laws of constitutional criminal procedure through explanation and discussion.

 Do you think there is too much media hype about these types of incidents? Or do you think the media is only reporting the tip of the iceberg?

Portfolio Deliverable Choice #2 – Overview of The Criminal Procedure Amendments and Related Doctrines (75 points)
Write a paper or create a PowerPoint presentation about the criminal procedure amendments that you have learned about at this point in the course (Modules One through Six). Explain the importance of each amendment. Discuss the related doctrines the Supreme Court has interpreted that arise out of that amendment. For instance, the Fourth Amendment prohibits unreasonable searches and seizures by the government. But the Supreme Court has determined additional doctrines arise out of this amendment, such as the plain-view doctrine. Thus, a discussion of the Fourth Amendment would necessarily include the plain-view doctrine as well, as an example. Your submission should give an overview of the amendment and discuss all such related doctrines.

The final Portfolio Project assignment continues the fact pattern that was introduced in Week 3 and continued in Week 6. Read the conclusion of the fact pattern here. In a well-written paper, answer the following questions:
 What constitutional issues, if any, arise with Amy’s case? Have her constitutional rights been violated and, if so, how? Have her constitutional rights been protected and, if so, how?
 What constitutional rights, if any, does Sven have? Should he be charged as a criminal, deported or considered a terrorist? If he is deported or deemed a terrorist, what treatment will he receive under either scenario? Which treatment do you think is the proper treatment of illegal aliens who make similar statements against America given your current understanding of the constitutional protections afforded the defendant?
 With respect to Toby, what constitutional issues, if any, arise? Have his constitutional rights been violated and, if so, how? Have his constitutional rights been protected and, if so, how?
 What constitutional issues arise with respect to Bill’s search, arrest, and plea? Does he have a right to an appeal and, if so, on what grounds? What actions can be taken against Officer Bill, Judge Meyer and Attorney Jones, if any, in Bill’s case?
 In the cases of Amy, Bill, Toby and Sven, the facts end before a trial actually occurs. Consider a defendant whose case goes to trial. What constitutional issues arise during the trial process? In your answer, focus specifically on the role of the defense attorney, prosecutor, judge and jury. From opening statements to sentencing, what constitutional concerns arise during a trial, and how is the defendant protected?
 In your answer, address both clear constitutional violations as well as facts that may not be a constitutional violation but that fall under the domain of constitutional criminal procedure, and explain how the right was not violated. Final Portfolio Deliverable Option # 2- Criminal Procedure: Balancing Protections for the Defendant and Protections for the Government – Discretion and Immunity (200 points)
Constitutional criminal procedure provides protections of the defendant balanced against interests of the government, be it law enforcement, prosecutors or courts. Yet, there is a tension between protections for the defendant and protections for the government in constitutional criminal procedure law. Some examples include:
 Police misconduct and good faith immunity defense
 Increased police power as a result of the war on terror and an arguable resultant diminished individual liberty
 Prosecutorial immunity
 Plea bargains and the problem of the innocent defendant
Discuss these tensions. Some things to address include:
 Reasons for protections and abuses that occur as a result.
 Do you support removing immunity? Or, is that protection necessary for the administration of justice?
 The increase in police power as a result of the war on terrorism and the effect on individual liberty.
 How does discretion affect the defendant throughout the criminal justice process? Consider the impacts of decision made by police, prosecutors and judges.
 Finally, what amendments are implicated in your discussion? Be sure to demonstrate an understanding of the applicable amendments by interweaving a discussion of the relevant criminal procedure amendments in this paper.
